In the retention and disposition schedule for the clerk <br />of superior courts office, the disposition instruction for the records in question is transfer to the State <br />Archives for permanent preservation. The sheriffs records according to the current retention and <br />disposition could have been destroyed by the originating agency. However, it is my determination <br />that these record, due to their historical significance, should be transferred to the State Archives. It <br />should also be noted that since the records in question are not currently in the possession of the <br />originating agency, our agency, through a written letter of consent, would authorize the transfer of <br />these records to the State Archives. Also, it is our determination that the above mentioned public <br />records should either be transferred to the State Archives (preferred) for permanent preservation or <br />returned to the originating agency for proper disposition. <br />Hopefully, the above descriptions of the relevant statutes have provided the necessary clarification.
