Coleman, Jr., County Attorney; and Betty June Hayes, Clerk to the <br />Board were also present. <br />Chairman Garrett referred to Ttem 1 on the Agenda: (Public He axing) <br />Chairman Garrett announced that this was the time and place for the Public Hearing <br />on the petition that had been filed by the Trustees of the Efland and Orange Grove Fire <br />Districts for the territorial exchange of certain areas between the two districts. <br />Commissioner Jan Pinney read the following: <br />"On the 20th day of May, 1975, the Board of County Commissioners o£ Orange <br />County set 8:00 p. m. on Tuesday June 17th in the Commissioners Room of the <br />Courthouse in Hillsborough as the time and place to conduct a public hearing <br />to consider a boundary line adjustment between the Efland and Orange Grove <br />Rural Fire Protection Districts. <br />Notice of this public hearing was published in the News of Orange County on <br />June 5th and June 12th. <br />It is now time to convene the public hearing. <br />The question to be considered at this hearing is: <br />Shall the boundary line between the >Efland and Orange Grove Rural Fire Protection <br />Districts be altered to run as follows: <br />Starting on State Road #1006 at the point where said road intersects with SR #1129 <br />and SR #1139 and which point is located on the present boundary line between the <br />Efland and Orange Grove Rural Fire Protection Districts and running in a westerly <br />direction along the center of State Road #1199 tv its end; then running in a <br />Westerly direction directly to the point where State Road #1125 and SR #1128 <br />intersect; running thence in a northwesterly direction directly to the intersection <br />of SR #1120 and #1119 in the community of suckhorn; running thence in a southwester- <br />ly direction along the center line of. .State Road #1120 to the point where said <br />road intersects with State Road ~R111Z, which point .is also a point on the present <br />boundary line between the Efland and Orange Grove Rural Fire Protection Districts." <br />Upon motion of Commissioner Finney, seconded by Commissioner Whitted, it was moved <br />and adopted that the boundary line between the Efland and Orange Grove Rural Fire Pro- <br />tection Districts be altered as described in the Resolution that had just been read. <br />Chairman Garrett stated that with the permission of the Board they would consider <br />Item #7 on the Agenda: (Orange County Medical Foundation): A representative of this <br />foundation•will_review with the Board of Commissioners the problem the foundation is <br />having with the loan guarantor provision in the Farmers Home Administrations contract. <br />The Foundation's attorney will outline his opinion of the County's legal ability to be <br />the loan guarantor. The County Attorney will react to this opinion. <br />Chairman Garrett recognized William C. Ray, President of the Orange County Medical <br />Foundation, Inc. Mr. Ray reviewed the purpose of the Foundation and informed the Board <br />that the Foundation now found itself in the position of not being able tv secure a <br />Farmers home Administration loan as the Agency was now requesting that the Foundation <br />secure a guarantor over and above the collateral of Assignments of Leases, Rents, and <br />Profits plus the land and building. Mr. Ray then introduced ^alton H. Loftin, Attorney <br />for the Foundation. Mr. Loftin read from Article 138, Chapter 131-126.18, of the General <br />Statutes and proceeded to give his interpretation of this Statute. Discussion ensued. <br />The Board requested the County Attorney to review the Statutes. Mr. Bernholz stated <br />that he had not been furnished the material that Mr. Loftin was quoting from. He would <br />like to have an opportunity to-study the Statute and conduct a research to see if the <br />proposal made was one the Commissioners could properly and lawfully live with. Mr. <br />Bernholz will present his findings at a later meeting. <br />Chairman Garrett referred to Item # 2 on t_he Agenda: (Selection of an alternate <br />Delegate to Triangle J Council of Governments). Recently approved changes in the bylaws <br />and charter of the Triangle J Council of Governments require that voting privileges of <br />any member unit be limited to duly appointed members or alternates. <br />The Chairman stated that the floor was now open for the nomination of an alternate <br />delegate to the Triangle J Council of Governments. <br />Upon motion of Commissioner Gustaveson, seconded by Commissioner Pinney, it was <br />moved and adopted that the Vice-Chairman of the Board of Commissioners, Commissiener <br />Whitted, be appointed as the Alternate Delegate to the Triangle J Council of Govern- <br />ments. <br />Chairman Garrett referred to item # 3 on the Agenda: (Appointments) <br />A. The term of William Breeze on the County Board of Social Services will expire <br />on June 30, 1975. f1r. Breeze is a County appointee. <br />Commissioner Wa7,lcer stated that he had been instructed by the Social Services <br />Board to nominate [ailliam H. Breeze as a member of the Social Services Board and "I do <br />so move for this nomination." The nomination was not accepted by the Board and dis- <br />cussion ensued. <br />
