5 <br />11. MODIFICATION. This Lease may be changed, waived, discharged or <br />terminated only by an instrument in writing signed by the party against which <br />enforcement of such change, waiver, discharge or termination is sought. <br />12. MERGER. This Lease contains the entire agreement between the <br />parties hereto and neither party is bound by any representations or agreements of any <br />kind except as herein contained.
