<br />ORANGE COUNTY BOARA OF COMMISSIONERS
<br />June 2, 1975
<br />The Orange County Board of Commissioners met on Monday, June 2, 1975, at 10:00 a.m.,
<br />in the Commissioners' Room of the Courthouse in Hillsbvrcugh, N. C_
<br />Members present were: Commissioners Flora Garrett, Norm Gustaveson, San Pinney,
<br />Norman Walker, and Richard Whitted.
<br />Members absent: None.
<br />5. M. Gattis, County Administrator; Veal Evans, Fiscal Officer; A. B. Coleman, Jr.,
<br />County Attorney; and Betty June Hayes, Clerk to the board, were present.
<br />Chairman Garrett referred to Item #1 on the Agenda: (Public Hearing is required
<br />prior to adopting the resolution formally creating the Orange"Water-Sewer Authority).
<br />Chairman Garrett stated "At the hour of 10:00 a.m., that pursuant to notice duly
<br />published, this was the place, date and time for a public hearing on a resolution pro-
<br />posed to be adopted by the Board of Commissioners for Orange County, North Carolina,
<br />signifying its determination to organize the Orange Water-Sewer Authority.
<br />The Chairman then announced that the Board of Commissioners proposed'-to appoint the
<br />following persons as members of the Orange Water and Sewer Authority for the indicated
<br />terms

<br />The Chairman then announced that the Soard of Commissioners would hear any resident
<br />of Orange County or any other interested person concerning the organization of the Orange
<br />Water-Sewer Authority.
<br />At said hearing a substantial number of citiaens, merchants, property owners and
<br />taxpayers were present and participated, including representatives of various civic
<br />and business associations, and full opportunity was given to all persons present to be
<br />heard, and, in addition, the Chairman presented certain facts on the results of studies
<br />and analysis which had been made of the water and sewer problems in Orange County and in
<br />the Towns of Garrbvro and Chapel Hill. No resident of Orange County or other interested
<br />person appeared, either in person or by attorney, to protest against the organization of
<br />the Orange Water-Sewer Authority, and the Clerk to the Board of Commissioners announced
<br />that no protest in writing had been presented.
<br />Thereupon Commissioner Jan Martin Pinney introduced the following resolution which
<br />was read:
<br />"RESOLUTION SIGNIFYING THE DETERMINATION OF THE HOARD OF
<br />COMMISSIONERS FOR ORPVGE COUNTY TO ORGAN22E AN Ai7THORSTY
<br />UNDER SECTION 162A-3.1 OF THE NORTH CAROLINA IVATER AND
<br />SEWER AUTHORITIES ACT (ARTICLE l OF CHAPTER 162A OP THE
<br />GENERAL STATUTES OF NORTH CAROLINA, AS A_*1ENDED).
<br />SE IT RESOLVED by the Board of Commissioners for Orange County that:
<br />Section 1. It is the determination of the Board of Commissioners for Orange
<br />County to organize an Authority under Section 162A-3.1 of the Nprt)1 Carolina Water
<br />and Sewer Authorities Act (Article 1 of Chapter 162A of the General Statutes of
<br />North Carolina, as amended).
<br />Section 2. The proposed Artioles o.f Incorporation of such Authority are as
<br />follows: ,

<br />In compliance with the North Carolina Water and Sewer Authorities Aot,
<br />being Article 1 of Chapter 162A of the General Statutes of North Carolina, as
<br />amended, the Board of Aldermen of the Town of Carrboro, North Carolina, the Board
<br />of Aldermen of the Town of Chapel Hill, North Carolina, and the Board of Commis-
<br />sioners for Orange County, North Carolina, each pursuant to a resolution signi-
<br />fying its determination to organize an Authority under Section 162A-3.1 of said
<br />Act, which Authority shall be a public body and a body politic and corporate of
<br />the State of North Carolina, hereby certify that:
