end result of the process is to provide decision makers with the information that would enable
them to make an informed decision of the environmental consequences of their actions.
The County Planning Department will consider the comments received from the SCH, the public,
and other County staff, and document its findings (i.e., FONSI, additional information is required,
or that an EIS is required).
Agency and public comments (as provided by the SCH) resulting from the review of the EA for
the West 54 LLC site are attached (see Section 7.0 -List of Exhibits).
3.® .7UMMARY CIF AGiEt~CY 4:OMMENTS ~'iEGARDING ®®EST 5`F Iod.V E/y
3.1 NCDENR -Division of Natural Resources Planning and Conservation. Natural
Heritage Program (NHP)
^ The Haw River Aquatic Significant Natural Heritage Area is in Collins Creek downstream
of the project area and has been documented to support the Federal Species of Concern
and State Endangered Brook Floater (a type of mussel) as well as the endemic and
federally Endangered Cape fear shiner (a type of fish), and the globally rare septima's
clubtail (a dragonfly).
^ Suggested a survey to determine if suitable habitat exists for the brook floater, Cape Fear
shiner, and the septima's clubtail. If habitat is found, coordination with NFIl', U.S. Fish
and Wildlife Service, N.C. Wildlife Resources Commision, and N.C. Plant Conservation
Program (and possibly other agencies) will be required.
^ These species are known in Collins Creek downstream of site; thus, all sediment and
erosion control measures would need to ensure that the habitats downstream of the site are
not affected.
^ NHP suggests avoiding vernal pools to avoid destroying amphibian habitats.
3.2 NCDENR -Division of Water Quality: Basinwide Planning Unit and SEPA Program
^ No specific comments, suggestion to minimize the use of impervious surface and to use
permeable surfaces when possible.
3.3 North Carolina Wildlife Resources Commission -Habitat Conservation Program
^ Cites the potential for habitats for the brook floater, state threatened creeper, state special
concern notched rainbow downstream of the site and two significant Natural Heritage
3 April 16, 2009
