2 <br />1 AGENDA ITEM: C1 <br />2 QUARTERLY PUBLIC HEARING <br />3 Review of a proposal to incorporate the Flood Damage Prevention Ordinance <br />4 into the existing Zoning Ordinance and onto the Official Zoning Atlas <br />5 <br />6 <br />7 Why are we doing this? <br />8 The County has been informed by the Federal Emergency Management Agency (FEMA) <br />9 and the State Office of Emergency Management that in order to continue participating within the <br />10 National Flood Insurance Program (NFIP) we had to revise the process utilized to review and <br />11 process flood regulations and map amendments to be consistent with current Statutory <br />12 requirements for zoning ordinance and atlas amendments. <br />13 <br />14 What is being proposed: <br />15 Existing regulations, currently within the s#and alone Flood Damage Prevention <br />16 Ordinance, .are being placed within the Zoning Ordinance. <br />17 <br />18 How are we doing this? <br />19 Staff proposes to create a new Special Flood Hazard Area (SERA) Zoning Overlay <br />20 District incorporating existing flood regulations within the Zoning Ordinance and incorporating <br />21 Flood Insurance Rate Map (FIRM) data onto the Zoning Atlas.. <br />22 <br />23 What is being proposed (continued): <br />24 •Processing/approval of map amendments to existing FIRM data that have already been <br />25 reviewed and approved by State and Federal officials, and <br />26 •Revie existing subdivision regulations to reference the new location of flood <br />27 regulations/definitions. <br />28 <br />29 Implications of proposed change: <br />30 No change to property owners <br />31 The proposed relocation of flood regulations will not have an impact on a property <br />32 owner's ability to make use of their property outside of the floodplain. Existing regulations will <br />33 still be in effect for any portion of a parcel of property located within an identified floodplain. <br />34 The only positive impact is related to the review and processing of Letters of Map <br />35 Amendment (COMA) and Letter of Map Revision (LOMR) <br />36 <br />37 Parcels Notified of proposal (map) <br />38 <br />39 History: <br />40 •Orange County began participating within the National Flood Insurance Program (NFIP) in <br />41 1981 <br />42 •The County adopted a standalone Flood Damage Prevention Ordinance (FDPO) along with <br />43 Flood Insurance Rate Maps (FIRM) <br />44 •Approximately twenty four hundred (2400) properties within the County's planning jurisdiction <br />45 are subject to compliance with flood regulations <br />46 <br />47 <br />48 <br />58 <br />
