5 <br />d. Correcting definitions and references in the Subdivision Regulations to reflect <br />FDPO terminology. <br />Further the Planning Board moved that: <br />1. Staff be requested to review whether additional modifications may be warranted in <br />Section 6.32.6 and Section 6.32.7 of the Orange County Zoning Ordinance to provide <br />waivers of requirements for extensive engineering studies in the event of the need to <br />introduce fill that has minimal impact on other properties in the area (Please refer to <br />Attachment Six (6) for staff's memo on this matter); and <br />2. The Planning Board invites the Board of County Commissioners to request a review of <br />provisions related to bona fide farms by the State Attorney General's office. (Please <br />refer to Attachment Seven (7) for the County Attorney's response) <br />FINANCIAL IMPACT: While there will be no financial impacts associated with the <br />implementation of amendments to the Subdivision Regulations, Zoning Ordinance, and Zoning <br />Atlas, Section 20.6.3 of the Zoning Ordinance requires all properties affected by a Zoning Atlas <br />amendment and all properties within 500 feet of an affected property be sent notifications. <br />Over $10,000 was spent to mail out 6,531 postcards and 1,822 certified letters. This cost <br />includes $640 in materials (labels, paper, postcards and envelopes), $7,448 for postage, and <br />$2,100 in staff time. <br />However, not making the revisions to the Flood Damage Prevention Ordinance may put the <br />County at risk of losing its FEMA accreditation. <br />RECOMMENDATION: The Administration recommends the Board: <br />1. Receive the Planning Board recommendation, <br />2. Close the public hearing, and <br />3. Adopt the resolution (Attachment One (1)) that amends the FDPO, Zoning Ordinance <br />text, Zoning Atlas, and Subdivision Regulations by: <br />a. Incorporating the amended FDPO text into the Zoning Ordinance text; <br />b. Creating a new Zoning Overlay District -Special Flood Hazard Areas (SERA) for <br />inclusion on the Zoning Atlas; <br />c. Affirming the various amendments to the FIRM (future SFHA Overlay District) <br />that FEMA approved on February 2, 2007; <br />d. Correcting definitions and references in the Subdivision Regulations to reflect <br />FDPO terminology; and <br />e. Repealing the FDPO. <br />
