ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: April 21, 2009 <br />Action Agen a <br />Item No. ~ (' <br />SUBJECT: Contract Amendment: Construction Manager at Risk Services, Hillsborough <br />Commons Upfit for Social Services <br />DEPARTMENT: Purchasing <br />PUBLIC HEARING: (Y/N) No <br />ATTACHMENT(S): <br />CMAR Contract Amendment <br />INFORMATION CONTACT: <br />Pam Jones, 919-245-2652 <br />PURPOSE: To consider approving a contract amendment in the amount of $2,781,457 with <br />Resolute Building Company (RBC), the Construction Manager at Risk ("CMAR") for the upfit of <br />space leased at Hillsborough Commons as offices for the Department of Social Services (DSS). <br />BACKGROUND: The Board of Commissioners entered into a 30-year lease with the owner of <br />Hillsborough Commons Shopping Center on June 3, 2008 for approximately 56,000 square feet <br />of space in a portion of the building previously occupied by Wal-Mart. This space will allow <br />consolidation of most personnel of the Department of Social Services and is intended as the <br />long-term location for the Department. The lease further includes an option to purchase the <br />entire shopping center in February 2012. At that time other Human Services functions now <br />housed at various locations in Central Orange County would be relocated to the Center. <br />On November 6, 2008 the Board awarded a contract for Construction Manager at Risk (CMAR) <br />services to Resolute Building Company (RBC) in the amount of $6,500- to provide <br />preconstruction services. This authorized RBC to work with the project team on pricing and <br />value engineering exercises associated with the upfit of the leased space. <br />This collaboration with RBC, the project architect, Corley Redfoot Zack (CRZ) and the DSS Staff <br />and Board culminated in a program for the space which was approved by the Commissioners on <br />December 1, 2008. Following the required bidding for the project by the CMAR, County staff <br />and CRZ conducted a value engineering exercise to ensure the approved program was <br />constructible within the project's $2.7 million construction budget set in the FY 2009-2019 <br />Capital Investment Plan. The Board is being asked to approve upfit costs for the space in the <br />amount of $2,781,457, which is the Guaranteed Maximum Price (GMP) contained in the <br />attached Contract Amendment #1. Note the $6,500 paid for preconstruction services is included <br />in this amount. <br />The project is scheduled to be completed in early fall 2009. <br />
