2/1911.999 DRAFT CaPY OF PROPOSED NSA ORDINANCE <br />SECTION 19. Article XVI is amended by adding a new Section 15-269 to read as follows: <br />2 <br />3 Section 15-269 Buffers in Northern Transition Area <br />4 <br />5 (a) The Board finds that: <br />6 (1) Soil and pollutants carried overland, primarily from roads, trails .and land <br />7 disturbing activities, can be effectively trapped by leaving a relatively <br />8 undisturbed strip of vegetation parallel and adjacent to the watercourse. <br />9 (2) Properly managed overland water flow can be directed into this buffer in a <br />10 manner that will reduce velocity and cause dispersion of the water. <br />11 (3) Sediments and associated pollutants carried by the water will settle out as a <br />12 result of this slowing and dispersion process. <br />13 (b) For purposes of this section, the term "Northern Transition Area" shall mean the <br />14 Transition Area portion of the Carrboro Joint Development Area as identified in the <br />15 Joint Planning Agreement. <br />16 (c) Development on lots within the Northern Transition Area shall, if any of the <br />17 watercourses identified below are located in whole or in part within the lots so <br />18 developed, contain a designated buffer area adjacent to such watercourses. The <br />19 buffer area boundaries shall be demarcated by a line connecting the points on either <br />20 side of the watercourse located as follows: <br />21 <br />22 (1) Bolin Creek and Tributaries (permanent streams flowing into Bolin Creek) <br />23 as shown on the Northern Transition Area Stream Buffer Map on file in the <br />24 Carrboro Planning Department, which map is incorporated herein by <br />25 reference. Measure along a line running perpendicular to the edges of the <br />26 floodplain (or if no floodplain has been demarcated, the center of the stream) <br />27 one hundred (100) feet from the edge of the floodplain (or if no floodplain has <br />28 been demarcated, from the edge of the water) plus an additional distance <br />29 equal to <br />30 <br />31 4 x slope x 100 <br />32 <br />33 where slope is expressed as a percentage derived from dividing by 100 the <br />34 rise of elevation between the floodplain boundary line (or if no floodplain has <br />35 been demarcated, the edge of the water) and a point one hundred (100) feet <br />36 from that point along the perpendicular line described above. <br />37 (2) Intermittent streams flowing into Bolin Creek and its tributaries as shown <br />3g on the Northern Transition Area Stream Buffer Map. Measure along a line <br />39 running perpendicular to and sixty (60) feet from the center of the <br />44 intermittent stream. <br />Page 29 of 3S <br />
