PUBLIC COMMENT: <br /> Rev. Robert Campbell said that here is another opportunity for a facility to come into <br /> the community and this will provide revenue that can go back into the community. He said that <br /> this facility would begin to eliminate the smell of the gas and would give the Board of County <br /> Commissioners the opportunity to show the community how progressive they can be. <br /> A motion was made by Commissioner Jacobs, seconded by Commissioner Nelson to <br /> approve the proposed agreement with the changes made to Article III, Item 82 requiring the <br /> University to begin payment for flaring gas upon the effective date of this agreement, and <br /> Article V, Item 94 requiring the University and/or the operator of the Landfill Gas collection <br /> system to accept liability for any claims related to off-site mitigation caused by the installation, <br /> construction, operation, maintenance or repair of the system; and that this item to come back <br /> as a consent agenda item at the Board's next regularly scheduled meeting reflecting these <br /> changes and any minor adjustments that may be necessary. <br /> Commissioner Gordon asked David Meezan's opinion on the motion and he said that it <br /> gets the County where it needs to be. <br /> VOTE: UNANIMOUS <br /> c. Proposal for Issuance of Capital Project Financing <br /> The Board considered a proposal for issuance of Capital Project financing to address <br /> financing needs related to authorizing capital projects. <br /> Chair Foushee reminded the Board that it agreed to consider item 4-i with this item. <br /> Financial Services Director Gary Humphreys said that this action is to pass a resolution <br /> to set a public hearing for March 3rd. This item will come back to the Board on March 171h. <br /> Staff proposes proceeding with alternative financing to be issued in April of 2009 for: <br /> County Campus and Library Development $25,000,000 <br /> Parks & Open Space 5,500,000 <br /> Affordable Housing 1,400,000 <br /> PIMS System 1,500,000 <br /> Solid Waste Equipment _217,000 <br /> $33,617,000 <br /> Gary Humphreys answered clarifying questions for Commissioner Gordon. <br /> Laura Blackmon said that currently the County has the capability to get a good rate and <br /> in the summer, the rates may go up. She said that it is timely to issue this debt now. <br /> Commissioner Yuhasz wants to make sure that the general obligation bonds would not <br /> be sold at a later date if the money is instead obtained now by alternative financing. Laura <br /> Blackmon said that the intent is to honor what the community approved in the bond <br /> referendum. <br /> Commissioner Jacobs said that the County has $2.8 million in undesignated Lands <br /> Legacy funds, which are now going to be alternatively financed. When the bonds were issued, <br /> Bob Jessup told the Board that conservation easements could not be bought with bond <br /> monies. He thinks that conservation easements would qualify as open space if using <br /> alternative financing. He wants to continue the conservation easement purchase program. <br /> Commissioner Gordon said that the voters were told that open space bond monies <br /> would be used for open space that had public access. She noted that conservation <br /> easements were not eligible because they did not have public access. <br />
