~_ ~~`1 r-"", ~ ~ Gam"' <br />_. <br />_. __ _.__.`-~ 1 <br />NORTH CAROLINA ~ ~ ~ ~! ; '' ! ~. ~1 <br />ORANGE COUNTY ,_ ._____._....___ _ ____.._ .._.___._.____ <br />This AGREEMENT, made and entered into this the 21'` day of lone, 1999, by and between Orange <br />County (hereinaRer referred to as "County") and the Town of Hillsborough (hereinafter referred to <br />as "Town"), to provide for periodic ftrc safety inspections of facilities within Town's jurisdiction as <br />mandated by the State of North Cazolina pursuant to the authority contained in Article 128 of <br />Chapter 153A and Article 20 of Chapter 160A of the North Carolina General Statutes. <br />WHEREAS, an agreement was made and entered into as of the 1" day of November, 1993, by and <br />between the County aa-d the Town, whereby the County pcrforincd State mandated f rC inspections <br />of facilities within the jurisdiction of the Town, and <br />WHEREAS, the Town has assumed the duties of performing fire inspections of the !revel One <br />facilities within the jurisdiction of the Town, and requires assistance and training for Level Two and <br />Level Three fire safety inspections. which is for approximately R9 (eighty nine) facilities, <br />NOW THEREFORE, for and in consideration of the mutual terms and agreements hereinafter sei <br />forth, the County and tho Town do agree ~ follows: <br />I. County will carry out, or cause to be carried out, within Town's .jurisdiction the minitxtum <br />schedule of inspections required to be performed by local governments puusuant to Section 107, <br />Volume V of the North Carolina Fire Prevention Code, for Level Twa and Level Three subject <br />facilities, The Town's T,evel One CertiEed Inspector snail perform inspections for Level One <br />facilities. <br />2. Appropriate officials of the County and "1-own shall continue to work together to produce a <br />schedule that identifies buildings, structures, and premises which are of priority fot' inspections <br />within Town's.jurisdiction, <br />3. County Fire Marshal will submit within five working days of the end of each month a copy of <br />osch fire safety i»speetion pcrfomted within Towsi's jurisdiction during that month to the Towrt'S <br />Code Enforcement Officer. <br />4. County Finance Office will invoice Town monthly for all inspections performed by the County <br />daring the prior month. Town will reimburse County for cost of a1i inspections performed by <br />County, except as rrwidtd below, within ten workins days of invoice in accordance with the <br />current fee schedule adopted by the Board of County Commissioners. Source of payment and <br />method for billing for inspections under this agreement shall be at Town's discretion and shall, in <br />n~ Way, bC ur bcx;ome a responsibility of County. <br />~ ., ~, <br />5. County will inspect all public school facilities within County's and Town's jurisdictions and aii <br />facilities ovmed by County or licensed by the Department of Social Services as care facilities within <br />Town's jurisdiction. County shall not invoice Town for such inspections. The County will perform <br />plans review in conjunction with the Ortutgc County Planning Department, until tlic Town Ict3pectur <br />obtains the minimal ccrtificatian required for the Level of facilities to be reviewed. A minimtun of <br />Level Two certification is required for Level One and Level Two Plans Review; and a Level Three <br />certification is required for Level Three Plans Review. <br />_ao~~ <br />
