"At the December meeting of the steering committee, Randolph County <br />requested to be added to the North Central Piedmont Resource <br />Conservation and Development Program. <br />Randolph County fills a gap in the basin oP the upper Cape Fear <br />River not now a part of the RD~CD project, though it gives rise <br />to Deep and Roc'~y Rivera, two of the major streams of the upper <br />basin. Tha peopple of'Randvlph, during the program's formative <br />period in 1967-68, were interested in joining but local cir- <br />cumstances at that time prevented them from doing so. <br />The area RCFcD steering committee last month unanimously approved <br />their addition to the project. Inclusion, however, is contingent <br />upon the approval of the original sponsors -- these being the boards <br />of county commissioners, the county planning boards, and the local <br />evil and water conservation districts. <br />Included with this letter is a draft of a resolution which will <br />meet this need. We present it for your consideration." <br />"A RESOLUTION FOR THE ADDITION OF RANDOLPR COUNTY TO THE <br />NORTH CENTRAL PIEDMONT RESOURCE CONSERYATTON AND DEVF,LOP- <br />MELVT PROGRAM OF NORTR CAROLINA. <br />WHEREAS Randolph County has requested to be included in the North <br />Central Piedmont Resource Conservation Program; and <br />WHEREAS Randolph County is an integral part of the geographic and <br />economic area of the upper Cape Fear River Basin; and <br />WHEREAS Randolph County is affected and affects the development of <br />the water and other natural resources of the upper Cape Fear River <br />watershed; <br />BE IT RESOLVED that the Orange County Bcard of Coaanissionera support <br />the addition of Randolph County to the North Central Piedmont Resource <br />Conservation and Development Program." <br />Upon motion of Commissioner Henry S, Walker, seconded by Commissioner Flora <br />Garrett, it was moved that the Resolution as presented by Mr. Davie be unanimously <br />adopted. <br />The Chairman referred the Board to Item ~6 of the Agenda: (Report by County <br />Attorney $tepa iSeoessary to Fhact a Building Inspection Program in Orange County.) <br />The County Attorney advised the Board that according to G. S, 143-1~8 the <br />Board could adopt a Resolution that would bring the County under the North Carolina <br />Building Code. <br />The Chairman referred the Board to Item 3 of the Agenda: (County Attorney <br />Reporting on New Statutes Controlling Disposal of Land by a County.) <br />Tha County Attorney advised the Board that the 1973 General Assembly had <br />enacted a Chapter that amended G.S. 1~3-176 and that now in accordance with G.S. <br />160A-267, 16DA-267, 160A~268, 160A_269 and 160A-270 effective February 1, 197., <br />the County could not dispose of any real property except in the following manner: <br />160A-267. Private Sale. When the council proposed to dispose of property <br />by private sale, it shall at a regular oouncil meeting adopt a resolution or <br />order authorizing an appropriate city official to dispose of the property by <br />private sale at a negotiated price. The resolution or order shall identify the <br />property to be sold and may, but need not, specify a minimum price. The <br />resolution or order shall be published once after its adoption, and no sale shall <br />be consummated thereunder until 10 days after its publication. (1971, c,698,s.1.) <br />160A-268. Advertisement fpr sealed bids. The sale of property by <br />advertisement for sealed bide shall be done in the manner prescribed by law for <br />the purchsaq of property, except that in the case of real property the <br />advertisement for bids shall be begun not less than 30 days before the date <br />fixed for opening bide. (1971,c.69$,s, l.) <br />160A-269. Negotiated offer, advertisement, and upset bids. A city may <br />receive, solicit, or negotiate an offer to purchase property and advertise it <br />for upset bide. When an offer is made and the council proposed to accept it, <br />the council shall reeuire the offeror to deposit five percent (S~) of his bid <br />with the city .clerk, and shall publish a notice of the offer. The notice shall <br />contain a general description of the property, the amount and terms of the <br />offer, and a notice that within 10 days any person may raise the bid by not leas <br />than ten percent (1C,~) of the first one thousand dollars ($1,000) and five <br />withethe(c~ty clerk fiveipercent~(s~)aofithesincreasedtbidblandrtheaclerkpshall <br />readvertise the offer at the increased bid. This procedure shall be repeated <br />until no further cualifying upset bids are received, at which time the council <br />may accept the offer and sell the property to the highest bidder for cash.
