5 <br />2. The Parties will deliver Solid Waste and County Recyclables to the System. <br />The County_ and the Towns all agree to deliver, or cause to be delivered; to System <br />Management Facilities for disposal or processing, respectively, all Solid Waste and County <br />Recyclables under their respective control. This delivery obligation includes (without limitation) <br />all Solid Waste and County Recyclables collected by any Pariy's employees, solid waste <br />collection contractors, solid waste collection licensees or solid waste collection franchisees. <br />There is no such obligation to deliver Other Recyclables. All Solid Waste and County <br />Recyclables delivered to System Management Facilities, or to County employees, solid waste <br />collection contractors, solid waste collection licensees or solid waste collection franchisees, or <br />properly placed in a designated container at a convenience center, will be County property upon <br />such delivery. <br />The County will have the right to refuse to accept for disposal at System Management <br />Facilities any material or substance which the County reasonably determines is barred from such <br />disposal by the Solid Waste Management Plan and Policies, by any applicable law or regulation <br />or by the restrictions of any permit. Notwithstanding the provisions of the previous paragraph, <br />the County shall in no event be deemed the owner of any such barred substance without its <br />express consent. <br />If at any time a material that previously qualified as Other Recyclables begins to be <br />processed by the County for recycling and therefore becomes County Recyclables, then any <br />Party theretofore processing such material as Other Recyclables shall begin to process such <br />material as County Recyclables upon the expiration of any contract for disposal of the material <br />as Other Recyclables that maybe in effect at the time of the material's change in status. <br />3. .Solid waste collection and transportation decisions <br />will remain each Party's prerogative. <br />The Parties in all events retain the right to determine their own systems and procedures <br />for the collection of Solid Waste and related matters, provided that such systems and procedures <br />shall be reasonably designed to be consistent and compatible with the appropriate Solid- Waste <br />Management Plan and Policies. <br />4. The County will operate the System as an enterprise operation, <br />and will have discretion to set rates, fees and charges. <br />The Parties agree that the long-term success of the arrangement for solid waste <br />management provided for in this Agreement requires that the Parties remain committed partners. <br />The Parties agree that their goal of reducing solid waste must be achieved in a manner that <br />guards the economic viability of the System's current and future operations. At the same time, <br />the Parties aclmowledge that the County is not expected to use its general funds to underwrite <br />overall solid waste management activities. Therefore, the County, the Towns and the persons <br />and organizations within their jurisdictions all must beaz appropriate proportional shares of the <br />Draft of June 1, 1999 3 <br />
