5/26/99 Appendix H Payment -in -Lieu Programs Around the Country Alternative Models for Programs 1. Davis, California (Ann Brunett) Methods of Acquiring Land: Mandatory land dedication: • Developers are required to mitigate land on a 1:1 ratio. • Land dedicated must fall within the city's general plan boundary. • Should be equal farmland if possible. If none can be found, they can seek a replacement somewhere else. The developers can create conservation easements on those properties, although the actual holder of the easement is sometimes controversial, with the county, Yolo County Land Trust, and the city all vying for control. • Often, the Land Trust will find money to pay for the easement, with the city providing matching funds which they have budgeted. Payment -in -lieu option: • A payment -in -lieu option of $2000 per acre is also available to the developer, although it is less desirable. • Money acquired spent within the general plan area. • This option is more expensive than the easements for developers and they can often find farmers willing to sell some of their land. Other: • Some local farmers create conservation easements on their own Focus of Acquisition: • The city concentrates its efforts around one creek in particular. • As the city acquires land around it, the Army Corps of Engineers will come in and repair it back to its original form under an 1135 grant. • Besides the creek, acquire land all over the city. • Made decision to buy more properties vs. one small piece
