Project Compliance with Town Subdivision, Zoning, artd EDD Regulations <br /> <br />This section is intended to address development ordinance compliance issues raised in the June <br />24 memo from Orange County Planning Director Craig Benedict. It will also detail how the <br />project would be reviewed and approved if it is annexed and, the development plan approved. <br />Towrt Approval Process <br />1. The Town's Planned Unit Development district requires the submittal and approval of a <br />development and phasing plan as part of the rezoning process. The development plan <br />provides enough information to ensure the desired mix of uses as well as an overall <br />indication of how the development will progress. Approval of the zoning and development <br />plan simply provides the Town with the general concept of the proposal and the developer <br />with sufficient approvals to proceed with detailed design work. This approval does not <br />authorize construction. - <br />2. Individual "pods" come back for further site specific review. This is the point at which <br />compliance with erosion control requirements & development ordinances is monitored. <br />• Single family sections are reviewed & held ~ to the standards of the Hillsborough <br />subdivision regulations, including open space and recreation facilities (Hillsborough <br />Planning Board & Town Board, no public hearing). <br />• Multi-family or attached housing are reviewed & held to the standards of the <br />Hillsborough Zoning Ordinance for similar operations, including recreation facilities <br />(Board of Adjustment, public hearing). <br />• Non-residential portions will be reviewed & held to the EDD standards (Board of <br />Adjustment, public hearing). <br />3. Zoning & building perrX-its would be issued for construction following approval by the <br />appropriate Town board. Both Town and County staff monitor construction. <br />4. Certificates of Occupancy are jointly issued by Town and County inspection staff. <br />Protect Compliance <br />Although the property would carry a different zoning designation (PUD), all non-residential <br />portions of the project will comply with the requirements and limitations placed on Primary I <br />EDD properties. <br />100 foot buffer around EDD The Manual was amended by Town & County to eliminate <br />perimeter buffer when the adjacent property was still zoned EDD. <br />The property across old 86 is also EDD, hence no buffer. <br />Rooftop visibility This will be addressed during site plan approval in compliance <br />with EDD manual. <br />Air conditioner visibility This will be addressed during site plan approval in compliance <br />with EDD manual. <br />Solid waste containers This will be addressed during site plan approval in compliance <br />with EDD manual. <br />Stormwater nurnagement A site-wide stormwater control plan will be submitted to the Town <br />Engineer before any individual pod is approved for construction. <br />Detention ponds and other on-site devices will be used. <br />`~:, <br />
