• <br /> Z.3 <br /> PLANNING PROJECT PROPOSAL #10 - November 2008 <br /> Lead Department: • Planning& Inspections <br /> Primary Contact(s): Craig Benedict (245-2692) <br /> Department interaction: Administration, County Attorney, Economic Development <br /> Subject: Modification of Special Use Permit Construction <br /> Timeframe <br /> • <br /> BACKGROUND; <br /> in accordance with the provisions of the Zoning Ordinance, development projects that <br /> are either a Planned Development and/or a Special Use have a one-year time period in <br /> which to commence land-disturbing activities or face the potential revocation of any and <br /> all approvals. <br /> ISSUE: • <br /> • <br /> While this requirement may be realistic for a small-scale, single use, project it is not <br /> practical for large, multi-phase projects, involving: <br /> 1. Infrastructure improvements (i.e. water and/or sewer) and State approvals, <br /> 2. Transportation Improvements requiring the issuance of permits by the North <br /> Carolina Department of Transportation, <br /> 3. Erosion control and stormwater management permits, and <br /> 4. Other similar local, State, and/or Federal permitting processes. <br /> In such instances, the necessary permits may take longer than a year for an applicant to <br /> obtain in order to commence land-disturbing activities. Further, unique economic <br /> conditions might also impact the ability of an applicant to commence land-disturbing <br /> activities in a timely fashion. <br /> PROPOSAL: <br /> Staff Is currently reviewing the feasibility of amending the Ordinance to modify the <br /> permit submittal and construction commencement requirements in an effort to provide <br /> some flexibility concerning large-scale, multi-phased, development projects. Ultimately, <br /> staff would like to require that a developer submit various permit applications to local, <br /> State, and/or Federal agencies in order to show progress in commencing the <br /> development of an approved project. <br /> • <br /> • <br />
