DRAFT # 1 . 5 <br /> (d) The Arts Commission shall as directed by the Program Guidelines review and consider <br /> the Committee recommendations, determine the qualifications of the Artists and the <br /> quality, cost and appropriateness of Artwork, and make recommendations to the <br /> BOCC on the selection of Artists and Artwork for Each Eligible Construction Project or <br /> existing public building or park or other outdoor public site or lands that is included in <br /> the Public Art Plan. The Arts Commission shall approve for recommendation to the <br /> BOCC a design contract for Artist services and, if and when appropriate, a separate <br /> contract for the Artwork, as recommended by the Committee, or may request another <br /> recommendation or set of recommendations from the Committee. The contract for <br /> Artist design services shall define a process for Artwork design development. If <br /> appropriate, separate contracts for Artwork, conservation or maintenance shall be <br /> proposed to provide for milestones for the delivery and installation of Artwork of other <br /> services. <br /> (e) The Arts Commission shall present to the BOCC its recommendations concerning the <br /> Artist and the Artist's style, the type of Artwork which would be expected to result from <br /> a commission or the specific Artwork recommended to be acquired or maintained or <br /> conserved, a proposed design contract for the services of said Artist and, if and when <br /> appropriate, separate contracts for the commissioning, conservation or maintenance of <br /> Artwork. The Arts Commission shall strive to make its recommendations in a timely <br /> manner to coincide, when possible, with any approval process for the overall design of <br /> the applicable Eligible Construction Project. <br /> (f) Over time, the Arts Commission should aim to achieve an appropriate balance among <br /> local, regional and national artists in the Public Art Program. While the enduring quality <br /> of the Artwork should be the primary consideration during Artist selection, effort should <br /> be directed to solicit RFP's from qualified local artists. <br /> Section 8.0 BOCC Approval of Artists and Artwork: <br /> The BOCC shall consider the recommendation of the Arts Commission, the qualification of <br /> the Artist and the quality, cost and appropriateness of the Artwork and services <br /> recommended by the Arts Commission, and may approve the associated contract for Artist <br /> design services and, if appropriate, separate contracts for the commissioning, conservation <br /> or maintenance of Artwork, as recommended by the Arts Commission, with or without <br /> conditions, or may request another recommendation or set of recommendations from the Arts <br /> Commission. <br /> Section 9.0 Percent for Art Program Execution: <br /> (a) Once an Eligible Construction Project is included in the approved Public Art Plan, and <br /> the Artist and Artwork selection and contract approval process outlined herein are <br /> complete, the Arts Commission shall be responsible for the supervision of Artists, the <br /> commissioning of Artwork and/or the purchase of Artwork. <br />
