1 <br /> DRAFT # 1 . 5 <br /> Section 6.0 BOCC Approval of the Public Art Plan: <br /> In conjunction with the approval of the County's annual Capital Improvement budget, the <br /> BOCC shall consider the Arts Commission's recommended Public Art Plan and may as it <br /> deems fit: <br /> (a) approve the Public Art Plan, or request resubmission of an amended Public Art Plan <br /> as directed by the BOCC; <br /> (b) designate fewer or more funds to the Public Art Allocation for a particular Eligible <br /> Construction Project than the proposed 1c/0 of the Eligible Construction Budget; <br /> (c) determine which Eligible Construction Projects in the Capital Improvement Program <br /> are not appropriate for Public Art due to low anticipated public visibility or public usage <br /> or due to other reasons and whether the Public Art Allocations related thereto are <br /> eligible to be pooled for use at a different Eligible Construction Project or at existing <br /> public buildings or parks or other outdoor public site or lands in Orange County that <br /> are not Eligible Construction Projects; and <br /> (d) designate additional discretionary funds to be added to the Public Art Fund. <br /> Section 7.0 Selection of Artists and Artwork: <br /> (a) The Arts Commission shall establish and draft and recommend for adoption by the <br /> BOCC a set of Percent for Art Program Guidelines and Policies ("Program <br /> Guidelines") which shall be consistent with policies of the BOCC and the terms of this <br /> Resolution, shall provide for adequate public input in the Artist and Artwork selection <br /> process, and provide direction for the selection of qualified Artists and appropriate <br /> Artwork and cost-effective appropriation and expenditures of the Public Art Fund and <br /> this Program. The public shall be invited and encouraged to participate in the <br /> formulation of the Program Guidelines. <br /> (b) Upon BOCC approval of the Program Guidelines, the Arts Commission shall appoint a <br /> committee (hereafter"Committee") to be chaired by an Arts Commission member. <br /> This committee shall include at least one representative each of the Orange County <br /> Arts Commission, the designer of the Eligible Construction Project for which the Public <br /> Art Allocation is to be expended (if relevant), the host County Department, the public at <br /> large, and at least two art professionals. <br /> (c) The Committee shall as directed by the Program Guidelines submit Requests for <br /> Qualifications (RFQ's) and Requests for Proposals (RFP's) for Artists and Artwork for <br /> each Eligible Construction Project or existing building or park or other outdoor public <br /> site or lands that is included in the Public Art Plan. The Committee shall receive and <br /> review the RFQ's and RFP's and select Artists and Artwork for recommendation to the <br /> full Arts Commission. <br />
