l0 <br /> DRAFT # 1 . 5 <br /> upon request for five (5) years, and still unexpended at the expiration of such period, shall <br /> be transferred to the general fund; provided that funds derived from other restricted <br /> sources shall revert to the funds from which originally appropriated at the expiration of <br /> said three- or five-year period, or if the Eligible Construction Project is canceled, as <br /> applicable. <br /> I. Any gift, grant or award received in the Public Art Fund and subject to a lawful condition <br /> shall be expended strictly in accordance with such condition. <br /> m. The Public Art Fund shall be used to provide sites for and Artwork in public places. Public <br /> Artwork may be placed on public display, integrated or attached to a public building or <br /> structure; detached within or outside a public building or structure; within or as a part of <br /> the landscape of a public park or other outdoor public site or lands; part of a portable <br /> exhibition or collection; part of a temporary exhibition; or loaned or exhibited in other <br /> public facilities. <br /> n. Unless restricted by the BOCC, any applicable resolution or ordinance, federal, state or <br /> local law or policy, or the conditions of a granting authority, the Public Art Fund may be <br /> pooled by the BOCC and expended for any Public Art and design project in the County, <br /> subject to the approved Public Art Plan. There shall be no general requirement that <br /> monies in the Public Art Fund be expended on the specific Eligible Construction Project <br /> that generated the monies unless as stated herein. <br /> Section 5.0 Annual Public Art Plan Recommendation: <br /> Prior to submission of the County's proposed annual Capital Improvement Program budget to <br /> the BOCC, the Arts Commission shall develop a Public Art Plan, detailing the Eligible <br /> Construction Projects to be implemented in the upcoming year. The Arts Commission shall <br /> submit the Public Art Plan to the BOCC with the County's proposed annual Capital <br /> Improvement Program budget for BOCC review and approval. The Public Art Plan shall: <br /> (a) identify Eligible Construction Projects in the Capital Improvement Plan that are subject <br /> to the 1% for Public Art Allocation; <br /> (b) identify the Eligible Construction Budget for each Eligible Construction Project in the <br /> Capital Improvement Program that is subject to the 1% for Public Art Allocation; <br /> (c) identify Eligible Construction Projects, which due to low anticipated public visibility or <br /> public usage or due to other reasons are not appropriate for Public Art. The Public Art <br /> Allocation for these projects shall, if eligible, be pooled with other monies in the Public <br /> Art Fund. The funding source for each Eligible Construction Project shall be identified <br /> and the County Manager shall indicate whether the funds can legally be pooled with <br /> other monies in the Public Art Fund for use at a different Eligible Construction Project <br /> or at existing public buildings or parks or other outdoor public site or lands in Orange <br /> County identified in the Public Art Plan that are not Eligible Construction Projects. <br />
