34 <br /> 2.3.6.33 All of these findings of fact shall be made in the indicated order by the <br /> Board of Adjustment, which is not empowered to grant a variance without <br /> an affirmative finding of fact shall be supported by substantial evidence in <br /> the record of proceedings before the Board. <br /> 2.3.6.34 The Board may impose reasonable conditions upon the granting of any <br /> variance to insure that the public health, safety, and general welfare shall <br /> be protected and substantial justice done. <br /> 2.3.6.45 Nothing in this section shall be construed to authorize the Board to permit <br /> a use in a district where that use is neither a Permitted Use nor a Special <br /> Use. <br /> PART IV. That Article 3 Establishment of Zoning District and Atlas, Section 3.10 Interpretation <br /> of District Boundaries of the Zoning Ordinance be amended as follows: <br /> 3.10 Interpretation of District Boundaries <br /> a) When there is any uncertainty as to the intended location of any zoning district <br /> boundary on the Zoning Atlas, the Zoning Officer shall make an interpretation of <br /> said Atlas upon request of any person. Any person aggrieved by any such <br /> interpretation may appeal such interpretation to the Board of Adjustment. The <br /> Zoning Officer and the Board of Adjustment, in interpreting the Zoning Atlas or <br /> deciding any appeal, shall apply the following standards: <br /> la) Boundaries indicated as approximately following the centerlines of streets; <br /> highways or alleys shall be construed as following such centerlines; <br /> 2b) Boundaries indicated as approximately following lot lines shall be <br /> construed as following such lot lines; <br /> 3e) Boundaries indicated as approximately following City Limits shall be <br /> construed as following such City Limits; <br /> 4d) Boundaries indicated as following railroad lines shall be construed to be <br /> the center line of the main track; <br /> 5e) Boundaries indicated as following shorelines shall be construed to follow <br /> such shorelines; in the event of change in the shoreline, the boundary shall be <br /> construed as moving with the actual shorelines; boundaries indicates as <br /> approximately following the centerlines of streams, rivers, canals, lakes or other <br /> bodies of water shall be construed as following such centerlines; boundaries <br /> shown as approximately following designated flood hazard area limits shall be <br /> construed as following such limits. <br /> 64) Boundaries indicated as parallel to or extensions of features indicated in <br /> Subsections A through E above shall be so construed. Distances not specifically <br /> indicated on the Zoning Atlas shall be determined by reference to the scale of the <br /> Atlas. <br />
