In general the Orange County ordinance mirrors the wording used in the North Carolina state model ordinance. The items not found in <br /> the ordinance or found, e�de rent ar ,,r <br /> -Item numbers 8, 10, 11;T2,e),and 36 were not found. <br /> -Item 13 (definitions)is missing some of the terms that are used in the ordinance or the definition is not adequate for floodplain <br /> management purposes. The missing or deficient definitions are listed under item 13. <br /> -Item 5 and 20(b)are deficient. Item 5 could be fine but the copy of the ordinance reviewed is not signed or dated.Also the ordinance <br /> found on Orange County website is the August 28, 1995 version. Item 20(b)is not clearly addressed. <br /> 2. The County includes an"Automatic adoption"provision in its ordinance. Ordinances containing the automatic adoption provisions <br /> were determined by the State Office of the Attorney General(September 14,2005) to not be compliant. The language in Section 42-38 <br /> should be revised to remove references to the FHBM and FBFM. While the County may leave in the automatic adoption language, this <br /> section must also reference the recently effective map panel(3710989000)dated May 16,2008. <br /> 3. There is an apparent contradiction in the ordinance between 42-92:1.which prohibits new construction in the SFHA and 42-92:3.a. <br /> which states that: "New or replacement manufactured homes shall be elevated...". <br /> 4. The reference in Division 3-Sec.42-94b. (Floodway and non-encroachment areas)to the section identifying the SFHA is incorrect. It <br /> should reference Section 42-38 not 42-37. <br /> 5. There are several references made to Section 3.2.This is the section from the previous ordinance and is now Section 42-38.
