The commercial terms set forth in this Agreement assume a Global Warming Potential (GWP) for methane of twenty-one (21)to calculate the Environmental Benefits that will result from the LFG Project's destruction of methane. Payments to the County will be adjusted as set forth below to the extent that the GWP for methane changes during the Term of this Agreement as follows: a. For any month in which the GWP of methane is twenty-three (23) or greater, as accepted under any Laws regulating the GHG emissions of the University, or, in the absence of such Laws, as provided in the then-current General Reporting Protocol for the Voluntary Reporting Program published by The Climate Registry, then the University shall make a payment to the County in the Monthly Billing Statement for such month equal to twenty-five percent (25%) of the product that results from multiplying the (i) lesser of the Average Allowance Market Price of Emissions Allowances or the Forecasted Carbon Price for such month by (ii) the difference between the number of metric tons of CO2e destroyed by the LFG Project calculated by reference to a GWP of twenty-three (23) or greater and the number of metric tons of CO2e destroyed by the LFG Project calculated by reference to a GWP of twenty-one (21).
