115. The University shall continuously monitor the LFG at Meter Points A and B, and <br /> such LFG will be measured, recorded, and totalized on an hourly, daily and monthly basis. The <br /> heating energy content of the LFG delivered to the flare shall be based on its measured monthly <br /> methane content at Meter Point B. The methane content shall be measured in SCF/month and <br /> shall be equal to the product of(a) the percent methane by volume, and (b) the LFG measured in <br /> SCF/month at Meter Point B (the "Meter Point B Methane Content"). For purposes of <br /> determining the Flare Payment,the total monthly heating energy content of the LFG measured at <br /> Meter Point B (the "Flare MMBTU HHV") shall be obtained by dividing the product of(a) the <br /> Meter Point B Methane Content, and (b) 1,012, by 1,000,000. Expressed in a formula, the Flare <br /> MMBTU HHV=Meter Point B Methane Content x 1012± 1,000,000. <br /> 116. For a given month during the Term of this Agreement, the Flare Payment shall be <br /> equal to the Flare Percentage, as such percentage may be adjusted in accordance with Paragraph <br /> 82 of this Agreement and/or Subpart E of this Article VII, multiplied by the product obtained by <br /> multiplying (i) the Flare MMBTU HHV for such month by (ii) the lesser of the BTU Equivalent <br /> Price or the Adjusted BTU Equivalent Price. Expressed in a formula,the monthly Flare Payment <br /> = 0.053 (as may be adjusted) x Flare MMBTU HHV x BTU Equivalent Price or Adjusted BTU <br /> Equivalent Price, whichever is less. A sample calculation of the Flare Payment is shown in <br /> Exhibit F. <br /> D. Payment for Gas Converted to Energy <br /> 117. Each month during the Term of this Agreement, the University shall make <br /> payments to the County based on the heating energy content of the LFG that is delivered to the <br /> Gas Conversion System (the "Conversion Payment") (a) commencing upon the Conversion <br /> Payment Date (as that term is defined in Article VIII hereunder); and (b) for any period during <br /> which the University operates the Gas Conversion System. <br /> 33 <br /> {00018638.DOC 24} <br />
