Staff bad origir~aHy intended to bring this item to the l*ebruary 211138 <br />Quarterly Public Hearing but work t~ras suspended when it was determined that the <br />proposal would involve major revisions to 'the Gaunty's existing Planned Develeprnent <br />standards contained witE~in Article Seven ~7~ of the Zoning ordinance. <br />ISSUE: <br />As the Beard may be aware from previous correspondence, North Carolina land use law <br />currently permits the uss of twQ (2) types of zoning districts that allow a governing body <br />to apply si#e~specitic development standards for a proposed project, specifically: <br />Conditional F3se Districts SCUD), which i$ currently re~leel.ed within our present <br />Pianned Develnpment (PD) regulations ct+ntainerl within Article Seven ~7) of the <br />Zoning Undinance, and <br />2. Conditional Zoning Districts (CZD). <br />l~s we currently have the substantial equivalent of a CiJD process, staff would like to <br />provide an explanation of the components of the CZD zoning construct. <br />Conditional Zanirfg Districts IiCZD~: <br />The CZI:] process allows for the establishrrtent of certain uses, which, because of their <br />nature or sca~fa, have particul2~r impacts on bath the immediate area, and tk~e community <br />as a whole. Through this pmcess a landowner presents asite-specific development <br />plan to the County far review and requests that a specific parcel of property be rezoned <br />to allow for the development of the proposed use. CZI~ Invaives the crea#lan of 'Tioating' <br />zoning districts tha#. can be applied in specific designated 'overlay' areas Qf the County <br />based on findings referenced within approved planning studies, Small Area Pions, or <br />the Grange County Carr~prebensive Plan. <br />T]~e major difference between the Gir1D and the CZt] process is that the CZD process <br />does not rettuire the issuance of a permit by the governing body, as is normally required <br />under the PDISUP process.
