Ward, seconded bq Commissioner Richard <br />Whitted, the following resolution was unanimously adopted. <br />NORTH CAROLINA <br />ORANGE COUNTY <br />Resolution ordering the abandonment and closing oP the area <br />- formerly inoluded in the right-of -way of a by-foot unnamed <br />roadwaq as shown in Plat Book 7, at page 6S, Orange County <br />Registry, being lonatad on the north side of St. Mary~a <br />Road (sometimes called ~uesa Road) and running northward <br />from the north aide of said road, which said road is <br />located outside of the City Limita.of the Town of Chapel <br />Hill. <br />WHEREAS, Roger G. Ceah and wife, Nancy M. Cash and Paul L. Addison and <br />wife Irene H. Addison filed Petition for the abandonment and closing of the <br />area formerly located within 60-foot unnamed roadway as shown in Plat Book <br />7, at page 6s, Orange County Registry, located on the north side of St. <br />Marq~s Road (sometimes called Guess Road) and running northward from the <br />north aide of said road located in Orange County in k~..v Township outside <br />the City Limits of Chapel Hill; and <br />WHEREAS, the above-named petitioners are the owners of all the property <br />adfsaent to the right-of-way of the road as described in the paragraph above <br />requested to be closed and abandoned; and <br />j+iHEREAS, the above-mentioned petition having been duly filed with the <br />Office of the County Manager of the County of Orange, the Board of County <br />Commissioners did set a time and plena for public hearing to be held upon <br />the question of abandoning and closing the above area included in the right- <br />af-waq of said unnamed 60-foot drive; and <br />WEiEREA$,,ths said notice of the time and place of such public hearing <br />was duly published in the OrangeGCounty Weekly: onae.•a.:week..for four successive <br />weeks as by law required; and <br />wa WEiEREAS, the portion of the areas formerly included in said right-of- <br />y petitioned to be closed and abandoned are not now a part of the State <br />Highway System nor presently under the control of said Highway Commission; and <br />Board Room oP thetSocialeServices Buildingrin Hillsborough,ONorth Carolina, <br />the said matter came regularly on to be heard pursuant to the notice above <br />referred to; and <br />WHEREAS, at said public hearing there was no ob3ection to the alosing <br />of the said above designated portion of the area formerly included in the <br />right-of-way of said 60-foot unnamed street as above described. <br />WHEREAS, all persons interested in its said matter were given an <br />opportunity to be heard at the time and plane of said public hearing. <br />NOW, TH~EFpRE, be it resolved by the Board of Couaty Commissioners of the <br />County of Orange: <br />1. That the Board oP Comrniasioners finds as a fact that the area formerly <br />included in that right-of-way of the 60-foot unnamed roadwaq as shown in <br />Plat Book 7, at page 65, Orange County Registry, being located on the north <br />side of St. Marq~a Road (sometimes called Guess Road) and running northward <br />from the north side oP said road, all as shown on said plat and as described <br />in Fetition filed by Roger G. Cash and wife, Nanaq M. Cash and Pav1 L. <br />Addison and wife, Irene H. Addison is not neaesaary to be opened for the use <br />by the public as a public street or way for travel thereon or thereover. <br />2. No individual, firm corporation or other owner of property in the <br />vicinitq of said described portion of the area formarlq included in the right- <br />of-way of said 60-foot unnamed drive will b® deprived of reasonable means of <br />ingress and egress to his, her, its or their property and that the abandonmeat <br />and alosing of said designated portion of the erase formerly included in said <br />right-of-way will not adverselq affect yr be detrimental to any propertq_in the <br />vicinity of said designated portion of the area formerly included in the <br />right-of-waq of said road to be alcaed and abandoned. _. <br />
