<br />Chairman Sennett read a letter from the Health Planning Council. Said <br />letter requested that the 8aard appoint two members to the Health Planning <br />Council. <br />Upon motion of Commissioner William C. Ray, seconded by Commissioner <br />Henry S. Walker, it was moved and adopted that Dr. 0. Aavid 13arvin and Vince <br />gavel be appointed ea members to the Health Planning Council for s term of <br />three years. <br />Chairman Bennett announced that the Board would at this time consider the <br />~ question of the County's participation in the proposed sanitary landfill - <br />operation. <br />Chairman Bennett recognized B. B. Olive oP D~ham. Imo. Olive stated that <br />he would like to organise a team of individuals who would make a solid waste <br />disposal study Por Orange County. He stated that he hoped the University of <br />North Carolina would be willing to grant the Town oP Chapel H111 just three <br />more cares oP land Por use as a landfill area for an additional year. He <br />requested that Orange County not invest any money in the proposed sanitary <br />landfill area on Embanks Road until all aspects of the appeal pending before <br />the State Board of Health could be resolved. kIa stated that hie appeal was <br />based on inadequate soil borings on a twenty-Five (2s) acre tract approved <br />for the landfill operation, the Paat that rook wsa reached at a shallow depth <br />in the holes bared on the cite, that no reasonable evidence had been offered <br />to eatabliah the fact that the walla in the immediate area would not be <br />polluted, the long run nowt of using the site could run into millions of <br />dollars if the site is underlain with rock, re ulationa from the State Board <br />of Health requires test borings to extend ten (10) feet below the maximum <br />trench depth., and that no teat borings extended below the ten (10) foot depth <br />of the trench, the application filed auggeated that the site would serve 39,OOD <br />people and that the people oP the County could not be served under the current <br />proposal, and that the life, in year a, oP this landfill had not been estimated <br />and thus it did not comply with the State Board of Health regulations. I+~. <br />Olive stated further that he intended to seriously pursue the appeals now on <br />file with the State Board oP Health. <br />Chairman Bennett read a summons that had been served upon him as Chairman <br />of the Berard. The summons ordered the County of Orange to be present in <br />court on Wednesday, September 27, 1972. The matter of the suit filed by the <br />New Hope Improvement Assooiation relative to the sanitary landfill operation <br />oa klxbanks Road was to be heard by Judge Thomas D. Cooper. The County <br />Administrator was directed to turn the complaint and the a~ona over to the _ <br />County Attorney. <br />Commissioner Norman Walker moved that the Board refrain from taking any <br />action on the sanitary landfill matter until the suit filed by the New Hape <br />Improvement Association had been heard in court and settled. Commissioner <br />Henry S. Walker offered a second to this motion. <br />Commissioner William C. Ray stated that he was opposed to the motion as he <br />felt the County should let the Town of Chapel Hill know what it intended to <br />do about the sanitary landfill matter. <br />Commissioner Tra A. Ward stated that he felt the Board was, at this time, <br />considering possible methods of how the County would participate in the <br />sanitary landfill err®a and he saw no reason to delay the discussipn on the <br />matter. <br />Chairman Bennett called Por a vote an Commissioner Norman Walker's motion. <br />Commissioners William C. Ray and Tra A. Ward voted aye. Commissioners Norman <br />Walker and Henry S. Walker voted nay. Chairman Bennett voted aye and then <br />declared the motion defeated. <br />Commissioner William C. Ray moved that after proper approvals, satisfactory <br />to the Beard, were received from the State Board of Health and the Court and <br />satisfactory agreements as to the ownership of the real estate the operation <br />and control of the landfill were agreed upon between the County and the Towns <br />of Chapel Hill and Carrboro that the County should signify its willingness to <br />financially participate in the proposed sanitary landfill operation on a .- <br />forty-three percent ((~.3~) basis. Commissioner Ira A. Ward seconded Commissioner <br />Ray's motion. Chairman Bennett 4alled for a vote on the motion. Commissioners <br />Harvey D. Bennett, Henry S. Walker, William C. Ray and Ira A. Ward voted aye. <br />Commissioner Norman Walker abstained. Chairman Bennett then declared the motion <br />passed. -' <br />
