<br />MINUTES OF THE ORANGE COUNTX <br />BOARD OF COMMISSXDNERS <br />~ 7 , ~. 4'79 <br />August 15, 1972 <br />The Board of County Commissioners of Orange County met in regular session <br />in the District Courtroom of the Courthouse in Hillsborough, North Carolina on <br />Tuesday, August 15, 1972, at S o~clock P.M, <br />Members Present: Chairman Harvey D. Bennett and Commissioners William C. <br />Ray, Renrq S. Walker, Ira A. Ward and C. Norman Walker. <br />Members Absent: None -- <br />Chairman Bennett reported to the members of the Board that he had received <br />a telephone call from Cliff Benson, Commissioner oP this Highway District. <br />~-~~~ Chairman Bennett instructed the Clerk to incorporate in the minutes the fact <br />that he as Chairman and Commissioners William C. Ray, Henry S. Walker and C. <br />Norman Walker met with the members of the Mebane Town Board of Aldermen for the <br />purpose of discussing the request of the Town oP Mebane for the Board to re-aonaider <br />and alter the agreement signed by the County and the Town relative to the monies <br />owed by the Town for the installation of water and sewerage lines to the Industrial <br />Park Area. The County requested the Town of Mebane to secure an opinion as to <br />whether or not the agreement Gould legally be altered and to also secure figures <br />on the cost of the treatment of water and sewerage now being utilized by the <br />Industrial Park Area. Orange County did decline, at this time, to .take any <br />action on the request~~' <br />Chairman Bennet pt resented an Ordinance entitled "AN ORDINANCE PROHIBITING <br />THE SALE OF OR PDSSESSIDN FCR CCNSIIMPTIDN CF BEVERAGES TN CERTAIN NON-RETURNABLE <br />OR DI$FDSABLE BEVERAGE CDNTAINERS WITHIN THE TOWN CF HILLSBOROUGH." This <br />Ordinance had been presented to the Board by Fred 3. Cates, Mayor, Town of <br />Hillsborough. Dissuasion ensued. It was agreed to take the matter under <br />advisement. <br />Chairman Bennett presented two letters from citizens who opposed the location <br />of a sanitary land fill on the Eubanks road and he presented s letter in support <br />of the area. He also read a letter Prom B. B. Olive, Attorney at Law, Durham, <br />North Carolina. Said letter made reference to the public hearing of August 3, <br />1972, which was called for the purpose of rezoning of the Hancock property as a <br />landfill site. Mr. Olive requested the Board to declare the publ3a hearing null <br />and void and he cited eight reasons for his request. Discussion ensued relative <br />.. to Mr, 01ive~s letter. <br />Upon motion of Commissioner William C. Ray, seconded by Commissioner Ira A. <br />Ward, it waa moved, that the Clerk notify Mr. Olive that the Board of Commissioners <br />declines to declare the public hearing of August 3, 1972, null and void and that <br />this decision is contingent upon the securing of an opinion from L. M. Cheshire, <br />County Attorney. The Clerk was further instructed to send a copy of the letter ~ . <br />to Charles M. Johnston, Chairman of the Orange County Planning Board. Chairman <br />Bennett called for a vote on the motion. Commissioners William C. Ray, Ira A. <br />Ward and Henry S. Walkex voted aye. Commissioner Norman Walker voted nay. Chairman <br />Sennett declared the motion passed. ~ <br />Chairman Bennett read a letter from Burnie Hillenbrand, Executive Director <br />of NACO, urging the Boards support of the Revenue Sharing Bill which was now before <br />the Senate Appropriations Committee. Said bill being designated as House Bill <br />1L~.370 (THE STATE AND LOCAL FISCAL ASSISTANCE ACT OF 1972). Discussion ensued. <br />Uoon motion of Commissioner William C. Ray, seconded by Commissioner <br />Norman Walker, it was moved, that Orange County send telegrams, one to each of <br />the North Carolina Senators and one to Senator John McClelland, Chairman of the <br />Senate Appropriations Committee, in support of House Bill ~11}37D. Chairman <br />Sennett Galled for a vote on the motion. Commissioners Henry S. Walker, William <br />C. Ray and Norman Walker voted ay®. Commissioner Ira A. Ward abstained from <br />voting. Chairman Bennett declared the motion passed. <br />Commissioner Piorman Walker brought to the attention of the Board the matter <br />of the unsitely condition of the Caldwell school building. He stated that the <br />citizens of the area were anxious to have the building demolished as they felt <br />it was an eye sore in their community. Discussion ensued ae to the ways that <br />said school property might be improved. <br />Upon motion of Commissioner William C. Ray, seconded by Commissioner Aenrq <br />S. Walker, it was moved and adopted, that the Clerk write a letter to the School <br />Board to request the School Board to clean and to clear the Caldwell school <br />property. <br />__~~' <br />
