• Ms. Beverly A. Blythe
Page 2
August 14, 2001
ordinance each year. My opinion in this regard is supported
further by additional language in G.S. § 153A-28 which allows the
compensation of a member of the Board of Commissioners who is a
full time County official to be adjusted at any time during "his
service as a full time official, for the duration of that
service." As you know, a county commissioner may serve as county
manager or interim county manager. In those instances the
compensation of the board member in the county official capacity
can be adjusted at times other than at the time of the adoption
of the budget ordinance.
As you'll probably recall the Board of County Commissioners'
compensation was adjusted at the time of the adoption of the
2000-2001 budget by allowing the members' compensation to change
with cost of living increases and merit increases approved
annually by the Board of County Commissioners when it adopted the
annual budget. Something similar can be done with this travel
allowance at the time the Board adopts the next County budget
• ordinance. That is, the County Commissioners' travel allowance
can be allowed to increase whenever an increase in the
reimbursement rate established for County employees is approved.
I recommend that you work with Elaine Holmes to craft the
resolution that would make that change for the next budget year.
Very truly yours,
COLEMAN, faLEDHILL & HARGRAVE, P.C.
E a~6~ledhill
GEG/lsg
Enclosure
xc: Kenneth T.
